What is personal data?

Personal data is information about you that enables you to be identified. This includes, for example: your surname, first name, address and email address. What data is requested?

Where our website provides the option to enter personal or business data (email addresses, names, addresses), the disclosure of such data by the user is entirely voluntary. However, by providing the optional data correctly, you enable us to provide you with personalised and individual support.

Where data is collected and processed via our contact form, it is encrypted before being transmitted. You are also welcome to send us confidential information by post.

Do you use cookies?

Cookies are small text files that we send to the browser on your device during your visit to our website and which are stored there. As an alternative to using cookies, information may also be stored in your browser’s local storage. Some functions of our website cannot be provided without the use of cookies or local storage (technically necessary cookies). Other cookies, however, enable us to carry out various analyses, so that we are able, for example, to recognise the browser you are using when you visit our website again and to transmit various pieces of information to us (non-essential cookies). Among other things, cookies help us to make our website more user-friendly and effective for you by, for example, tracking your use of our website and identifying your preferred settings (such as country and language settings). Where third parties process information via cookies, they collect this information directly via your browser. Cookies do not cause any damage to your device. They cannot execute programmes and do not contain viruses.

We provide information about the specific services for which we use cookies in the individual processing operations. Detailed information on the cookies used can be found in the cookie settings at the top of this privacy policy.

How can you influence the use of personal data?

Naturally, you have the sole right to decide whether and for what purposes we may use your data. Furthermore, you alone determine whether we may use your data for the purposes of advice, advertising and market research. Here too, of course, you may withdraw your consent at any time once it has been given.
We adhere to the principles of data avoidance and data minimisation. We therefore only store your personal data for as long as is necessary to fulfil the purposes set out here or as required by the various retention periods stipulated by law. Once the relevant purpose no longer applies or these retention periods have expired, the corresponding data will be blocked or deleted as a matter of routine and in accordance with legal requirements.

What security measures have we put in place?

We have put in place technical and administrative security measures to protect your personal data against loss, destruction, manipulation and unauthorised access. All our staff and service providers are bound by us to maintain confidentiality and to comply with data protection regulations.
Whenever we collect and process personal data, it is encrypted before being transmitted. This means that your data cannot be misused by third parties.

Will this privacy policy be amended?

In light of current developments, such as amendments to the Federal Data Protection Act (BDSG-neu, GDPR, TDDDG), we will update this privacy policy where necessary.

How can I check, correct, withdraw or delete my data?

Subject to the provisions of the General Data Protection Regulation (GDPR) and the Federal Data Protection Act (BDSG), you, as the data subject, have the right to:

  • access, in accordance with Article 15 of the GDPR and Section 34 of the BDSG, to the personal data held about you in the form of meaningful information regarding the details of the processing, as well as a copy of your data;
  • Rectification, in accordance with Article 16 of the GDPR, of any inaccurate or incomplete data stored by us;
  • Erasure, in accordance with Article 17 of the GDPR, of the data we hold about you, provided that the processing is not necessary for the exercise of the right to freedom of expression and information, to fulfil a legal obligation, or for reasons of public interest, or for the establishment, exercise or defence of legal claims;
  • Restriction of processing in accordance with Article 18 of the GDPR, insofar as the accuracy of the data is disputed, the processing is unlawful, we no longer require the data and you object to its erasure because you require it to establish, exercise or defend legal claims, or you have objected to the processing in accordance with Article 21 of the GDPR.
  • Data portability pursuant to Article 20 of the GDPR, where you have provided us with personal data on the basis of consent pursuant to Article 6(1)(a) of the GDPR, Section 25(1) of the TDDDG or on the basis of a contract pursuant to Article 6(1)(b) of the GDPR, and this data has been processed by us using an automated procedure. You will receive your data in a structured and machine-readable format, or we will transfer the data directly to another controller, provided this is technically feasible.
  • You have the right to object, in accordance with Article 21 of the GDPR, to the processing of your personal data, insofar as this is carried out on the basis of Article 6(1)(e) or (f) of the GDPR and there are grounds for this arising from a particular situation, or where the objection relates to direct marketing. However, the right to object does not apply if compelling legitimate grounds for the processing are demonstrated, or if the processing is carried out for the purpose of establishing, exercising or defending legal claims. Where the right to object does not apply to specific processing operations, this will be stated in the relevant section.
  • Withdrawal of your consent in accordance with Article 7(3) of the GDPR with effect for the future. You may lodge a complaint with a supervisory authority in accordance with Article 77 of the GDPR if you believe that the processing of your personal data infringes the GDPR. You may contact the supervisory authority for your usual place of residence, your place of work or our registered office. Further information on the supervisory authorities in the European Union can be found here.

Legal basis for processing

Article 6(1)(a) of the GDPR and Section 25(1) of the TDDDG serve as the legal basis for our company’s processing operations where we obtain consent for a specific purpose of processing. If the processing of personal data is necessary for the performance of a contract to which the data subject is a party – as is the case, for example, with processing operations required for the delivery of goods or the provision of other services or consideration – the processing is based on Article 6(1)(b) of the GDPR. The same applies to processing operations necessary for the implementation of pre-contractual measures, such as in cases of enquiries regarding our products or services. Where our company is subject to a legal obligation requiring the processing of personal data, such as to fulfil tax obligations, the processing is based on Article 6(1)(c) of the GDPR.

In rare cases, the processing of personal data may be necessary to protect the vital interests of the data subject or another natural person. This would be the case, for example, if a visitor were to be injured on our premises and their name, age, health insurance details or other vital information subsequently had to be disclosed to a doctor, a hospital or other third parties. In such cases, the processing would be based on Article 6(1)(d) of the GDPR. Finally, processing operations may be based on Article 6(1)(f) of the GDPR. This legal basis applies to processing operations not covered by any of the aforementioned legal bases, where the processing is necessary to safeguard a legitimate interest of our company or a third party, provided that the interests, fundamental rights and freedoms of the data subject do not take precedence. We are permitted to carry out such processing operations in particular because they have been specifically mentioned by the European legislator. In this regard, the legislator took the view that a legitimate interest might be assumed if the data subject is a customer of the controller (Recital 47, second sentence, of the GDPR).

Who receives my data?

We only disclose your personal data, which we process on our website, to third parties if this is necessary to fulfil the purposes and is covered by the legal basis (e.g. consent or the safeguarding of legitimate interests) in each individual case. Furthermore, we may disclose personal data to third parties in specific cases where this serves to establish, exercise or defend legal claims. Potential recipients may then include, for example, law enforcement agencies, solicitors, auditors, courts, etc.

Where we use service providers to operate our website who process personal data on our behalf as part of a data processing arrangement in accordance with Article 28 of the GDPR, these may be recipients of your personal data. Further information on the use of data processors and web services can be found in the overview of the individual processing operations.

How exactly is my data processed?

Below, we provide information on the individual processing operations, the scope and purpose of data processing, the legal basis, the obligation to provide your data and the respective retention period. No automated decision-making, including profiling, takes place in individual cases.

Provision of the website

Nature and scope of processing
When you access and use our website, we collect the personal data that your browser automatically transmits to our server. The following information is temporarily stored in a so-called log file:

  • IP address of the requesting computer
  • Date and time of access
  • Name and URL of the file accessed
  • Website from which access is made (referrer URL)
  • Browser used and, where applicable, your computer’s operating system, as well as the name of your internet service provider

Our website is not hosted by us directly, but by a service provider who processes the aforementioned data on our behalf for the purpose of providing the website, in accordance with Article 28 of the GDPR.

Purpose and legal basis
The processing is carried out to safeguard our overriding legitimate interest in displaying our website and ensuring its security and stability, on the basis of Article 6(f) of the GDPR. The collection of the data and its storage in log files is strictly necessary for the operation of the website. There is no right to object to the processing due to the exception under Article 21(1) of the GDPR. Insofar as the continued storage of log files is required by law, the processing is carried out on the basis of Article 6(1)(c) of the GDPR. There is no legal or contractual obligation to provide the data; however, it is technically impossible to access our website without providing the data.

Retention period
The aforementioned data is stored for the duration of the website’s display and, for technical reasons, for a maximum of 7 days thereafter.

The processing of your data when using our contact form is carried out for the purpose of communication and processing your enquiry on the basis of your consent in accordance with Article 6(1)(a) of the GDPR and Section 25(1) of the TDDDG. Insofar as your enquiry relates to an existing contractual relationship with us, the processing is carried out for the purpose of fulfilling the contract on the basis of Article 6(1)(b) of the GDPR. There is no legal or contractual obligation to provide your data; however, it is not possible to process your enquiry without the information in the mandatory fields. If you do not wish to provide this data, please contact us by other means.

Retentionperiod
Where you use the contact form on the basis of your consent, we will store the data collected for each enquiry for a period of three years, starting from the date your enquiry is dealt with or until you withdraw your consent.
If you use the contact form in the context of a contractual relationship, we will store the data collected for each enquiry for a period of five years from the end of the contractual relationship.

Contact form for job applicants

Nature and scope of processing
On our website, we offer you the option to submit a job application to us via a form provided. The information collected via mandatory fields is required to process your enquiry. In addition, you may voluntarily provide further information which you consider necessary for the processing of your enquiry.
When using the application form, no data is passed on to third parties.

Purpose and legal basis
The processing of your data resulting from the use of the application form is carried out for the purpose of processing your application and deciding on the establishment of an employment relationship, in accordance with Section 26 of the Federal Data Protection Act (BDSG). There is no legal or contractual obligation to provide your data; however, it is not possible to process your application without the information in the mandatory fields. If you do not wish to provide this data, please use other methods to apply to us.

Retention period
We store the data collected for the duration of the application process; in the event that you are not appointed, for a period of six months from the date of rejection; and in the event of appointment, for a period of seven years following the end of your employment.

Presence on social media platforms

We maintain so-called fan pages, accounts or channels on the networks listed below in order to provide you with information and offers via social media and to offer you further ways to contact us and find out about our services. Below, we explain which data we, or the relevant social network, process in connection with your access to and use of our fan pages/accounts.

Data we process about you
If you wish to contact us via Messenger or direct message on the relevant social network, we will generally process your username, which you use to contact us, and may store any further data you provide, insofar as this is necessary to process or respond to your enquiry.
The legal basis is Article 6(1)(f) of the GDPR (processing is necessary for the purposes of the legitimate interests pursued by the controller).

(Statistical) usage data we receive from social media platforms
We receive statistics relating to our accounts that are automatically provided via Insights features. The statistics include, amongst other things, the total number of page views, ‘Likes’, details of page activity and post interactions, reach, video views, and information on the proportion of men and women amongst our fans and followers.
The statistics contain only aggregated data that cannot be traced back to individual persons. We are therefore unable to identify you from this information.

What data the social networks process about you
You do not need to be a member of the relevant social network to view the content on our fan pages or accounts, and no user account for that social network is required for this purpose.
Please note, however, that when you visit the relevant social network, it collects and stores data even from website visitors without a user account (e.g. technical data required to display the website to you) and uses cookies and similar technologies, over which we have no control. Further details can be found in the privacy policies of the respective social network.
If you wish to interact with the content on our fan pages/accounts – for example, by commenting on, sharing or ‘liking’ our posts – and/or contact us via messaging functions, you must first register with the relevant social network and provide personal data.
We have no control over the data processing carried out by the social networks in connection with your use of their services. To the best of our knowledge, your data is stored and processed in particular in connection with the provision of the respective social network’s services, and furthermore to analyse usage behaviour (using cookies, pixels/web beacons and similar technologies), on the basis of which interest-based advertising is displayed both within and outside the relevant social network. It cannot be ruled out that, in the process, your data may also be stored by the social networks outside the EU/EEA and passed on to third parties.
Information on, amongst other things, the exact scope and purposes of the processing of your personal data, the retention period/deletion, and policies on the use of cookies and similar technologies in connection with registration and use of the social networks can be found in the privacy policies/cookie policies of the social networks. You will also find information there regarding your rights and options to object.

Facebook

When you visit our Facebook page, Facebook collects, amongst other things, your IP address and other information stored on your computer in the form of cookies. This information is used to provide us, as the operators of the Facebook pages, with statistical information regarding the use of the Facebook page. Facebook provides further information on this at the following link: https://de-de.facebook.com/help/pages/insights.
We are unable to draw any conclusions about individual users from the statistical information provided. We use this information solely to cater to the interests of our users, to continuously improve our online presence and to ensure its quality.
We collect your data via our fan page solely to facilitate communication and interaction with us. This collection generally includes your name, the content of your messages and comments, as well as the profile information you have made ‘public’.
The processing of your personal data for the purposes set out above is based on our legitimate business and communication interests in providing an information and communication channel in accordance with Article 6(1)(f) of the GDPR. Should you, as a user, have given your consent to data processing to the respective social network provider, the legal basis for the processing extends to Article 6(1)(a), Section 25(1) of the German Teleservices Data Protection Act (TDDDG) and Article 7 of the GDPR.
As the actual data processing is carried out by the social network provider, our ability to access your data is limited. Only the social network provider is authorised to have full access to your data. Consequently, only the provider can directly take and implement the necessary measures to fulfil your user rights (requests for information, requests for erasure, objections, etc.). The most effective way to exercise these rights is therefore to contact the relevant provider directly.
We are jointly responsible with Facebook for the personal data contained on the fan page. Data subjects’ rights may be exercised with Facebook Ireland as well as with us.
Under the GDPR, the primary responsibility for the processing of Insights data lies with Facebook, and Facebook fulfils all obligations under the GDPR with regard to the processing of Insights data; Facebook Ireland makes the key elements of the Page Insights Supplement available to data subjects.
We do not make any decisions regarding the processing of Insights data or any other information arising from Article 13 of the GDPR, including the legal basis, the identity of the data controller and the retention period for cookies on users’ devices.
Further information can be found directly on Facebook (Supplementary Agreement with Facebook): https://www.facebook.com/legal/terms/page_controller_addendum.

Matomo (Piwik)

This website uses Matomo, an open-source software programme that collects and stores data. This information is used for marketing and optimisation purposes. To this end, Matomo creates pseudonymous usage profiles from the data. For these purposes, the software stores cookies (text files) on your computer, which can be used to analyse your use of the website. Your IP address is anonymised immediately after processing and before storage. The data collected via Matomo is stored on our own servers. It is not passed on to third parties.

If you do not wish Matomo to store cookies, you can prevent the installation of cookies via your browser settings (you can find information on this in your browser’s help function). In this case, you may not be able to use all the features of the website.

Google Analytics

On the basis of our legitimate interests (i.e. our interest in the analysis, optimisation and commercial operation of our online service within the meaning of Article 6(1)(f) of the GDPR), we use Google Analytics, a web analytics service provided by Google Inc. (‘Google’). Google uses cookies. The information generated by the cookie regarding users’ use of the online service is usually transferred to a Google server in the USA and stored there.

Google is certified under the Privacy Shield Agreement and thereby provides a guarantee of compliance with European data protection law (https://www.privacyshield.gov/participant?id=a2zt000000001L5AAI&status=Active).

Google will use this information on our behalf to analyse how users use our website, to compile reports on activity within the website, and to provide us with other services relating to the use of this website and internet usage. In doing so, pseudonymous user profiles may be created from the processed data.

We use Google Analytics to ensure that adverts placed within Google’s advertising services and those of its partners are shown only to users who have demonstrated an interest in our online service or who exhibit certain characteristics (e.g. interests in specific topics or products, determined on the basis of the webpages visited), which we transmit to Google (so-called ‘remarketing’ or ‘Google Analytics audiences’). We also use Remarketing Audiences to ensure that our adverts are tailored to users’ potential interests and do not come across as intrusive.

We only use Google Analytics with IP anonymisation enabled. This means that users’ IP addresses are truncated by Google within Member States of the European Union or in other States party to the Agreement on the European Economic Area. Only in exceptional cases is the full IP address transmitted to a Google server in the USA and truncated there.

The IP address transmitted by the user’s browser is not combined with other data held by Google. Users can prevent the storage of cookies by adjusting the settings in their browser software; users can also prevent Google from collecting the data generated by the cookie and relating to their use of the online service, as well as the processing of this data by Google, by downloading and installing the browser plug-in available via the following link: tools.google.com/dlpage/gaoptout.

This data is processed exclusively for the purposes mentioned above and to maintain the security and functionality of Google CDN. Newsletter distribution via CleverReach

This website uses CleverReach to send newsletters. The provider is CleverReach GmbH & Co. KG, Schafjückenweg 2, 26180 Rastede, Germany (hereinafter: “CleverReach”). CleverReach is a service that enables the organisation and analysis of newsletter distribution. The data you provide in order to subscribe to the newsletter (e.g. email address) is stored on CleverReach’s servers in Germany or Ireland.

Our newsletters sent via CleverReach enable us to analyse the behaviour of newsletter recipients. This allows us, amongst other things, to analyse how many recipients opened the newsletter and how often each link in the newsletter was clicked. With the help of so-called conversion tracking, it is also possible to analyse whether a predefined action (e.g. the purchase of a product on this website) took place after a link in the newsletter was clicked. Further information on data analysis via CleverReach newsletters is available at: https://www.cleverreach.com/de/funktionen/reporting-und-tracking.

Data processing is carried out on the basis of your consent (Article 6(1)(a) of the GDPR). You may withdraw this consent at any time by unsubscribing from the newsletter. The lawfulness of any data processing operations that have already taken place remains unaffected by the withdrawal.

If you do not wish your data to be analysed by CleverReach, you must unsubscribe from the newsletter. We provide a link for this purpose in every newsletter message.

The data you have provided to us for the purpose of receiving the newsletter will be stored by us or the newsletter service provider until you unsubscribe from the newsletter, and will be deleted from the newsletter distribution list once you have unsubscribed. Data stored by us for other purposes remains unaffected by this.

After you unsubscribe from the newsletter distribution list, your email address may be stored on a blacklist by us or the newsletter service provider to prevent future mailings. The data from the blacklist is used solely for this purpose and is not combined with any other data. This serves both your interests and our interest in complying with legal requirements when sending newsletters (legitimate interest within the meaning of Article 6(1)(f) of the GDPR). There is no time limit on the retention of data on the blacklist. You may object to this retention provided that your interests outweigh our legitimate interest.

For further details, please refer to CleverReach’s privacy policy at: https://www.cleverreach.com/de/datenschutz.

Conclusion of a data processing agreement
We have concluded a data processing agreement with the provider of CleverReach and fully comply with the strict requirements of the German data protection authorities when using CleverReach.
